GENERAL TERMS AND CONDITIONS OF SALE – ARTIST IN CHAOS

1. SCOPE
These Terms apply to all payments made in connection with participation in the Artist in Chaos exhibition, including virtual and physical formats.
Artist in Chaos is a curated exhibition created by Aby M’Baye (Aby Golden Lady B), and not a traditional commercial gallery.
2. SERVICES
Participation fees grant access to artistic and curatorial services, which may include:
* virtual exhibition presence
* physical exhibition (depending on selected option)
* online gallery page
* social media promotion
* curatorial dialogue
* editorial features (interviews, artbook inclusion)
The exact scope depends on the selected participation package.
3. PARTICIPATION CONFIRMATION
Participation is confirmed only upon:
* acceptance of the artist’s submission
* full payment of the participation fee
4. PRICING
All prices are indicated in Euros or USD
Prices may be updated at any time prior to payment.
5. PAYMENT
Payments must be made in full to secure participation.
Payment methods are processed via secure third-party providers.
6. REFUND POLICY
* A partial refund may be requested within 14 days following payment
* After 14 days, payments are strictly non-refundable
* No refunds will be issued once services have been delivered or the exhibition period has begun
Payments cover organisational, production, and curatorial costs.
7. ARTWORK SALES
Artists are free to sell their work.
* No commission is taken by Artist in Chaos
* Sales are conducted directly between the artist and the buyer
* Artist in Chaos may act as a facilitator, but is not a contractual party to the sale
8. RESPONSIBILITY
Artist in Chaos acts as a curator and organiser.
Artists remain fully responsible for:
* authenticity of their work
* pricing
* delivery and condition of artworks
9. LIABILITY
Artist in Chaos cannot be held responsible for:
* sales disputes between artist and buyer
* shipping or delivery issues
* third-party services
10. ARTIST WITHDRAWAL AND SELECTION RIGHTS
Artist Withdrawal
Participation in Artist in Chaos constitutes a commitment for the full duration of the project.
If an artist chooses to withdraw from the project before its completion:
* The participation fee remains fully due
* No refund will be issued, regardless of the stage of withdrawal
Payments cover curatorial, organisational, and production efforts that are engaged upon confirmation.
Curatorial Selection
Artist in Chaos is a curated project.
As curator, Aby M’Baye reserves full discretion to:
* accept or decline submitted artworks
* ensure alignment with the curatorial themes (including friendship, resistance, and burnout)
If a submitted artwork is not selected:
* The curator may choose an alternative artwork from the artist’s existing body of work (including publicly available works on the artist’s platforms), in dialogue with the artist when possible
Right to Refuse or Remove Participation
Artist in Chaos reserves the right to:
* refuse participation if payment has not been completed
* remove from the project if their behaviour, communication, or actions are deemed harmful to the integrity, reputation, or functioning of the project
Such decisions are made at the curator's sole discretion and do not entitle the artist to any refund.
All decisions are final.
11. FORCE MAJEURE
We are not liable for delays or cancellations due to circumstances beyond our control.
